This page lists what Hawaii publishes about licensing an HVAC or mechanical contractor and contracting with homeowners: who issues the licence, whether one is required statewide, the classes and qualifications, insurance or bond minimums, reciprocity with other states, renewal and continuing education, and the state's home-improvement contract statute if it has one.
It is built for owners of residential HVAC companies, especially those hiring across a state line or opening a second territory. Every entry is a snapshot of what the cited source published on the verification date; it is a research starting point, not legal advice.
Hawaii, field by field.
- Contractor licensing authority
- Hawaii Department of Commerce and Consumer Affairs (DCCA), Professional and Vocational Licensing Division, Contractors License Board (HAR § 16-77-3: "Board" means the contractors license board; § 16-77-1: the Board's authority to adopt rules is found in HRS chapter 444).
- HVAC licence required
- Statewide above a dollar threshold. HAR § 16-77-4(a): "No person within the purview of this chapter shall act, or assume to act, or advertise, as a contractor, general engineering contractor, general building contractor, or specialty contractor without a license" under HAR chapter 16-77 and HRS chapter 444. Threshold: DCCA's "Hire a Licensed Contractor" page states that a licence is required "for any project exceeding $1,500 in labor and material" and "for any project that requires a building, electrical or plumbing permit"; the Board's FAQ dated 7/9/18 states the exemption as an aggregate contract price of "not more than $1,000.00" where no building permit is required. The statutory exemption (HRS § 444-2) could not be read on 2026-10-14 — capitol.hawaii.gov returned HTTP 403 — so the threshold is not verified against the statute; a 2026 bill (HB 846, introduced; status not read) recites the existing § 444-2(4) text as "not more than [$1,500]", with the proviso that the exemption does not apply where a building permit is required, and proposes $2,500. The HVAC classification is the C-52 Ventilating and air conditioning contractor: "To fabricate, assemble, and install warm-air heating and air cooling systems including heating and cooling solar systems, complete ventilating systems and complete air conditioning systems" including piping, non-electrical controls, instrumentation, building automation, energy management, related trenching and insulation, and "installation of heat pumps related" to the air conditioning system (HAR 16-77 Exhibit A, Specialty Contractor Classifications, dated May 23, 2003, incorporated by § 16-77-28(c); also reproduced in the Board's Description of Contractor License Classifications dated June 20, 2014).
- Licence classes & qualifications
- Specialty contractor "C" classification C-52 (HAR § 16-77-28(a)), held by a sole proprietor or by an entity through a responsible managing employee (RME) (§ 16-77-18(c)). § 16-77-18(a): every individual applicant or RME shall have had, within the ten years preceding the application, "not less than four years of supervisory experience as a foreman, supervising employee, or contractor in the particular classification" (self-employed or unlicensed experience may be accepted at the Board's discretion, § 16-77-18(b)); § 16-77-10(a) requires "A minimum of three notarized letters" certifying honesty, financial integrity and experience and a current credit report covering at least the previous five years, and § 16-77-10(b) requires every applicant other than an RME to furnish a CPA-prepared financial statement and a state tax clearance; §§ 16-77-39 and 16-77-40 require written Part I (business and law) and Part II (trade) examinations; § 16-77-44: "A grade of seventy-five per cent shall be a minimum passing grade for each part of any examination"; § 16-77-71(a)(4) requires the principal RME to be in residence in the State while the entity's licence is in effect. The Board FAQ states the same four-year supervisory experience requirement, and the Board's application page states that an applicant who fails to take and pass the examination within 6 months of becoming eligible has the application abandoned (HRS § 436B-9).
- Insurance / bond minimum
- HAR § 16-77-10(b)(5) requires a certificate of insurance "showing full policy coverage of the applicant for liability and property damage insurance with the following minimum limits of liability": bodily injury liability $100,000 each person and $300,000 each occurrence, and property damage liability $50,000 each occurrence; § 16-77-10(b)(4) requires proof of workers' compensation coverage or of exclusion from HRS chapter 386; § 16-77-10(b)(6) requires "Any surety bond imposed by the board"; § 16-77-11(a)(3) lets the Board require a surety bond as proof of financial integrity; § 16-77-55(b)(3) conditions renewal on proof that liability and property damage insurance has been maintained in the same amounts, and § 16-77-76 requires any Board-imposed bond to be maintained for at least one year before a waiver request. HRS § 444-11.1 (as quoted on Board notice CT-25): failure to maintain the required workers' compensation insurance, liability insurance or bond "shall cause the automatic forfeiture of the license" as of the expiration or cancellation date.
- Reciprocity
- None. The Board's FAQ states: "Does Hawaii have reciprocity agreements with other states? No. All applicants must meet the same licensing and examination requirements."
- Renewal & continuing education
- HAR § 16-77-50: licensees must submit the renewal application, required documents and fees "on or before September 30 of each even-numbered year"; a licence not renewed "shall be forfeited as of October 1 of the even-numbered year"; § 16-77-51 allows a forfeited licence to be restored with a penalty fee "on or before November 30 of the renewal year", after which a new application is required (the Board FAQ and notice CT-25 describe this as a 60-day restoration window). The Board page lists "Renew By License Expiration Date: September 30, 2026" with on-time renewal fees of $338 (entity or sole proprietor, active), $208 (RME, active) and $160 (inactive) and requires a DOTAX tax clearance issued within six months of renewal. No continuing-education requirement is published for contractor licences: § 16-77-55 conditions renewal on financial-integrity documents, insurance and bond compliance, and the only refresher-training rule in HAR 16-77 (§ 16-77-116) applies to asbestos contractors.
- Home-improvement contract rule
- HRS § 444-25.5 (as set out on Board notice CT-25) requires a contractor, before entering into a contract and applying for a building permit, to explain verbally in detail the lien rights of all parties and the homeowner's option to demand bonding, and to provide a written contract that includes those disclosures, the HRS chapter 672E notice ("CHAPTER 672E OF THE HAWAII REVISED STATUTES CONTAINS IMPORTANT REQUIREMENTS YOU MUST FOLLOW BEFORE YOU MAY FILE A LAWSUIT...") and the signatures of contractor and homeowner. HAR § 16-77-80(a) requires the written contract to state the contractor's name, address, licence number and classification; "The exact dollar amount due from the homeowner under the contract"; the start date and number of days for completion; the scope of work and materials; the approximate percentage of work to be subcontracted with subcontractor names and licence numbers; a statement of the risk of loss of payments made to a sales representative, printed in capitals next to the owner's signature line; a provision explaining lien rights; warranty terms; and both signatures; § 16-77-80(b): "The contract shall be executed prior to the performance of any home construction or improvement"; § 16-77-80(c) excludes service-type work that does not require a county permit. HAR § 16-77-79 requires pre-contract disclosure of lien rights, scope, percentage subcontracted, bonding status, licence number and classification, warranties and a cost estimate. No deposit cap appears in these rules; the door-to-door sales chapter (HRS ch. 481C) could not be read (capitol.hawaii.gov returned HTTP 403).

HRS chapter 444 text (capitol.hawaii.gov returned HTTP 403 on 2026-10-14, after certificate errors in the research pass), including the § 444-2 licence threshold — DCCA's current page states $1,500 and a 2026 bill (HB 846) recites current law as $1,500, while the Board FAQ dated 7/9/18 states $1,000; HB 846 would raise the exemption to $2,500 and its status could not be read. Whether the Board imposes a surety bond on a new C-52 licensee (discretionary under § 16-77-11(a)(3)). HRS chapter 481C door-to-door sales rules (not read). The Board FAQ's fee figures (7/9/18) differ from the Board page's current renewal fees.
