[ 01 ]WHAT THIS PAGE ISSCOPE

This page lists what Minnesota publishes about licensing an HVAC or mechanical contractor and contracting with homeowners: who issues the licence, whether one is required statewide, the classes and qualifications, insurance or bond minimums, reciprocity with other states, renewal and continuing education, and the state's home-improvement contract statute if it has one.

It is built for owners of residential HVAC companies, especially those hiring across a state line or opening a second territory. Every entry is a snapshot of what the cited source published on the verification date; it is a research starting point, not legal advice.

[ 02 ]THE STATE RULEDATASHEET

Minnesota, field by field.

Contractor licensing authority
Minnesota Department of Labor and Industry (DLI). DLI states: "While there is no state license required for mechanical contractors, businesses must file a $25,000 mechanical contractor bond with DLI" in order "to contract to perform gas, heating, ventilation, cooling, air conditioning, fuel burning or refrigeration work"; DLI also states "mechanical contractors must comply with local licensing requirements."
HVAC licence required
Statewide (bond filing only) — no state licence exists for mechanical/HVAC contractors; "A person contracting to do gas, heating, ventilation, cooling, air conditioning, fuel burning, or refrigeration work must give and maintain bond to the state in the amount of $25,000 for all work entered into within the state", filed with the commissioner of labor and industry (Minn. Stat. § 326B.197(a)); the residential building contractor and remodeler licence requirement does not apply to "a mechanical contractor" (defined in § 326B.802, subd. 8) or to "specialty contractors who provide only one special skill" (§ 326B.805, subd. 6), and HVAC is not one of the eight "special skill" categories in § 326B.802, subd. 15.
Licence classes & qualifications
No state HVAC/mechanical licence class, exam or experience requirement is published; the only statewide filing is the $25,000 mechanical contractor bond. DLI's residential building contractor and remodeler licences apply to a contractor providing "two or more special skills" (Minn. Stat. § 326B.802, subds. 11-12) and DLI states "Specialty contractors who provide only one special skill are not required to have a state license."
Insurance / bond minimum
$25,000 mechanical contractor bond, which "must be written by a corporate surety licensed to do business in the state" and "must be filed with the commissioner of labor and industry"; it "is in lieu of all other bonds to any political subdivision required for work covered by this section" (Minn. Stat. § 326B.197(a)). Filing fee $100 (§ 326B.197(b): "a biennial bond filing fee of $100"; DLI bond page). No general-liability insurance minimum is stated for mechanical contractors.
Reciprocity
None published — the DLI mechanical contractor bond page and Minn. Stat. § 326B.197 contain no reciprocity provision, and there is no state HVAC licence.
Renewal & continuing education
Bond filing "is valid for two years"; "The renewal fee for a bond filing is $100" (DLI bond page; § 326B.197(b) "biennial bond filing fee of $100"). No CE requirement published for mechanical contractors; DLI's continuing-education page lists no HVAC or mechanical credential (its 14-hour requirement applies to residential building contractor, remodeler and roofer qualifying persons).
Home-improvement contract rule
Minn. Stat. § 326B.809 ("WRITTEN CONTRACT REQUIRED") requires all agreements between a DLI licensee and a customer, including proposals, estimates, bids, quotations, contracts, purchase orders and change orders, to be in writing with a detailed summary of the services to be performed, the specific materials or standard features, and the total price or how it will be calculated, and "All agreements shall be signed and dated by the licensee and customer"; it applies to licensees (residential building contractors, remodelers, roofers), not to bond-only mechanical contractors. Minn. Stat. § 326B.811 lets an insured who contracts with a residential building contractor, remodeler or roofer for work paid from property or casualty insurance proceeds cancel "within 72 hours after the insured has been notified by the insurer that the claim has been denied", with a boldface statement of at least ten-point type, a detachable duplicate "NOTICE OF CANCELLATION" form, and refund within ten days. Minn. Stat. §§ 325G.06–325G.07 (home solicitation sales) let a buyer cancel a sale of goods, services or improvements to real property with a purchase price over $25, personally solicited and agreed to away from the seller's place of business, "until midnight of the third business day after the day on which the home solicitation sale occurs" by written notice; sales the buyer initiated by requesting a repair or maintenance visit, bona fide emergency sales with a signed waiver, and sales of real property are excluded (§ 325G.06). Minn. Stat. § 327A.02, subd. 3 imposes statutory home-improvement warranties on a "home improvement contractor" (§ 327A.01, subd. 10), including a two-year warranty on home improvements "involving the installation of plumbing, electrical, heating or cooling systems" against defects "caused by the faulty installation of the system or systems". No deposit cap and no state home-improvement contractor registration located on the pages read.
