[ 01 ]WHAT THIS PAGE ISSCOPE

This page lists what South Dakota publishes about licensing an HVAC or mechanical contractor and contracting with homeowners: who issues the licence, whether one is required statewide, the classes and qualifications, insurance or bond minimums, reciprocity with other states, renewal and continuing education, and the state's home-improvement contract statute if it has one.

It is built for owners of residential HVAC companies, especially those hiring across a state line or opening a second territory. Every entry is a snapshot of what the cited source published on the verification date; it is a research starting point, not legal advice.

South Dakota, field by field.

Contractor licensing authority
None at state level for HVAC. The Department of Labor and Regulation's list of occupational and professional licensing boards names the South Dakota Electrical Commission and the South Dakota Plumbing Commission and no board for HVAC, mechanical, heating, air conditioning or refrigeration contractors; the statewide Boards and Commissions portal (145 entries) lists only the "Electrical Commission, State of South Dakota" and "Plumbing Commission, State of South Dakota" among construction-trade licensing bodies. The Department of Revenue requires a contractor's excise tax license of "Any person entering into a contract for construction services" (SDCL chs. 10-46A and 10-46B, as cited by the Department).
HVAC licence required
None at state level — no state board or licence for HVAC or mechanical contractors appears on the Department of Labor and Regulation's boards list or the state Boards and Commissions portal; state construction-trade licensing covers electrical work (Electrical Commission) and plumbing (the Plumbing Commission "Licenses all qualified plumbers, sewer and water installer, appliance installers, manufactured and mobile home, underground irrigation installers, water conditioning installers, and individual and small on-site wastewater system (septic) installers within the state"); a contractor's excise tax license is required for construction-services contracts, with the tax "at a rate of 2%" on gross receipts (Department of Revenue; SDCL ch. 10-46A).
Licence classes & qualifications
No state HVAC licence class exists on the official pages read. The Plumbing Commission's appliance contractor licence ("Have one year of experience as an appliance installer.") and appliance installer licence ("Have two years' experience as an appliance apprentice.") are the only state licences with a possible overlap; the Commission's pages do not define "appliance" and do not mention heating, air conditioning, HVAC, furnaces or gas piping.
Insurance / bond minimum
None at state level — no state HVAC licence exists (see HVAC Licence Required), so no state bond or liability-insurance minimum for HVAC contractors is published on the official pages read.
Reciprocity
None at state level — no state HVAC licence exists, so no reciprocity provision for HVAC contractors is published.
Renewal & continuing education
None at state level — no state HVAC licence exists. (Plumbing Commission licences "expire annually on Dec. 31"; plumbing contractors, plumbers and third-year apprentice plumbers licensed by exam must show continuing education before renewal.)
Home-improvement contract rule
None located for a home-improvement-specific statute or contractor registration; the Attorney General's consumer-law list names no such statute. SDCL 37-24-5.1 to 37-24-5.7 (door-to-door sales, within the Deceptive Trade Practices chapter) apply to any sale, lease or rental of goods or services "with a purchase price of twenty-five dollars or more" in which the seller personally solicits the sale and the buyer's agreement or offer "is made at a place other than the place of business of the seller" (§ 37-24-5.1): the seller must furnish a fully completed receipt or contract stating, in ten-point bold type in immediate proximity to the buyer's signature, "YOU, THE BUYER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION" and inform the buyer orally of the right to cancel (§ 37-24-5.3(1)-(2)); furnish a completed, detachable "NOTICE OF CANCELLATION" form in duplicate (§ 37-24-5.4); may not include any confession of judgment or waiver of the right to cancel (§ 37-24-5.5); and must refund all payments within ten business days of receiving a valid cancellation (§ 37-24-5.6(1)). Excluded are a visit the buyer requested "for the purpose of repairing or performing maintenance upon the buyer's personal property", except for additional goods or services sold during the visit (§ 37-24-5.2(5)), and a buyer-initiated bona fide emergency with a handwritten, signed waiver (§ 37-24-5.2(3)). The Attorney General's Division of Consumer Protection page restates the three-day right, the $25 floor and the ten-day refund. SDCL § 44-9-13 (amended by SL 2026, ch 180) makes it theft for a contractor, subcontractor or supplier who receives property of another "for the purpose of improvement of real estate" to appropriate it, with intent to defraud, "for any purpose other than the payment for labor, skill, or materials for improvement of the real estate for which it was received". No deposit cap located.

What to confirm.

Authority address note: (DLR licensing boards list); https://dor.sd.gov/businesses/taxes/contractors-excise-tax/ (contractor's excise tax license). Not verified in words on any official page: that no statewide HVAC or mechanical contractor licence exists (the DLR and Boards and Commissions lists show no such board but do not state the absence); confirm with the Plumbing Commission whether gas-fired furnace or water-heater installation falls under its appliance installer licence; and confirm local mechanical-contractor licensing with the city or county permitting office — non-official search results point to city licences in Sioux Falls and Rapid City, which no official page read confirms.
