[ 01 ]WHAT THIS PAGE ISSCOPE

This page lists what Arkansas publishes about licensing an HVAC or mechanical contractor and contracting with homeowners: who issues the licence, whether one is required statewide, the classes and qualifications, insurance or bond minimums, reciprocity with other states, renewal and continuing education, and the state's home-improvement contract statute if it has one.

It is built for owners of residential HVAC companies, especially those hiring across a state line or opening a second territory. Every entry is a snapshot of what the cited source published on the verification date; it is a research starting point, not legal advice.

Arkansas, field by field.

Contractor licensing authority
Arkansas Heating, Ventilation, Air Conditioning and Refrigeration (HVACR) Licensing Board (created by Ark. Code §17-33-201), administered by the Arkansas Department of Labor and Licensing, Code Enforcement Section, 900 West Capitol, Suite 400, Little Rock, AR 72201 ([email protected]), under Act 277 of 1991 as amended (Ark. Code §17-33-101 et seq.).
HVAC licence required
Statewide. Ark. Code §17-33-301(a): "It is unlawful for any person to engage in HVACR work without the appropriate license or registration provided by this chapter, unless exempted pursuant to this chapter"; §17-33-303(a): "every individual who designs, installs, constructs, maintains, services, repairs, alters, or modifies any HVACR system or any portion of an HVACR system in the State of Arkansas shall obtain one (1) of the following classes of license"; "HVACR" means "the design, installation, construction, maintenance, service, repair, alteration, or modification of a product or of equipment in heating and air conditioning, refrigeration, ventilation, or process cooling or heating systems" (§17-33-101(6); Board Rules §III(8)). An individual may perform HVACR work under a Class A, B, D or E licence holder by registering with the Department, and the licence holder is responsible for the registrant's annual registration (§17-33-303(c); Rules §V(A)(6)). A person licensed or registered under the chapter "shall not be required to obtain a license from any city or county to perform HVACR work", but local permits and inspections apply (§17-33-104). No dollar threshold appears in the chapter or the rules. Exemptions (§17-33-102; Rules §XIX) include household appliances, AGA-approved unvented space heaters, self-contained refrigeration equipment of 1.5 hp or less, window air conditioners of 36,000 BTUH or less not connected to ducts, work by a person on a building owned and occupied as his or her home or on his or her farm, public utilities, motor vehicles, hospital employees, LP-gas licensees (§17-38-301 et seq.) on gas-fired floor and wall furnaces and unit heaters, apprentices in listed trades working under a licensee, and a person or public entity servicing or repairing its own system with its own trained personnel. Statute text read from the Department's "HVAC/R Statutes 2025" compilation (dated 10/29/2025).
Licence classes & qualifications
Ark. Code §17-33-303(a) (as compiled in the Department's HVAC/R Statutes 2025): Class A — "HVACR work without limitation to BTUH or horsepower capacities"; Class B — air conditioning systems "of not more than twenty-five (25) tons of cooling capacity per unit or one million (1,000,000) BTUH heating input per unit and refrigeration systems of fifteen horsepower (15 h.p.) or less per unit"; Class D — sheet metal/ductwork, with no sale, installation or service of HVACR equipment; Class E — refrigeration, with no heating and air conditioning equipment for human comfort; Class L — restricted lifetime licence for licensees aged 65 or older. The posted 17 CAR §261-103 carries the same classes. The Board's rules effective June 3, 2022 (§IV) still show Class B at 15 tons and a Class C service-and-repair licence; the Board's August 1, 2025 memo states that Act 746 of 2025 "Repeals the Class C license for HVAC/R", grandfathers Class C holders to Class B, and that "The Class B license is now allowed to perform work of HVAC/R equipment up to 25 tons". Qualifications: at least 18 years of age, application on Board forms, payment of fees and passing "the appropriate examinations specified by the board" (§17-33-302(a)); examinations are proctored by Prov and applicants "must be pre-approved by the Board" (Board page); applicants with no licensing background "shall present satisfactory evidence of having at least two (2) years experience as an HVACR contractor or an employee of an HVACR contractor", with Board-approved education substitutable for experience, and "In no case shall apprenticeship, education, or training be a prerequisite or condition for licensure" (Rules §V(A)(3), (5)). Annual licence fees: Class A $200, Class B $150, Class D $150, Class E $150, Class L no charge, registrant $25 (§17-33-204(b), the statutory maximum under §17-33-204(c); 17 CAR §261-106); examination fee $100 (17 CAR §261-106(g); Rules §VII(8): $55 written / $100 computerized).
Insurance / bond minimum
Rules (effective June 3, 2022) §XVIII(4): "A license holder who holds a class A, B, C, D, or E license shall maintain liability insurance for any work performed or shall be covered by an employer policy with the minimum coverage. The minimum coverage of the policy shall be $250,000 for an individual licensee or $250,000 per licensed employee for an employer provided policy. Proof of coverage shall be presented to the Board at the time of issuance or renewal of license." The posted 17 CAR §261-117 carries the same $250,000 figures, and Ark. Code §17-33-202(8) authorizes the Board to "Establish by board rule a minimum level of general liability insurance coverage for a license". The Board's August 1, 2025 memo adds that a class holder employed by a contractor, a business that services its own equipment, a school or a supply company "will not be responsible to provide individual liability insurance coverage" and instead provides an employer letter. Surety bond: none stated in the statute or rules read.
Reciprocity
None published by state. The Board's page states: "The Arkansas Department of Labor and Licensing's State HVAC/R Board has no reciprocal licensing agreements with any other state licensing Boards for HVAC/R licensing at this time." Rules §V(A)(3) directs the Board to approve for licensure "with examination" an applicant currently licensed in another jurisdiction whose HVACR laws are "substantially similar" (a national model mechanical code plus a nationally proctored comprehensive examination) and in good standing; Rules §XIII authorizes reciprocal agreements under which examination, continuing education and apprenticeship are not prerequisites; Rules §XX grants automatic licensure to active-duty service members stationed in Arkansas, returning veterans within one year of discharge, and their spouses who hold a substantially equivalent licence (Ark. Code §17-1-106).
Renewal & continuing education
Licences and registrations "shall expire one (1) year after the date of issuance or at a time specified by the HVACR Licensing Board" (Ark. Code §17-33-306; Rules §VI(1); 17 CAR §261-105(a): "the last day of the month one (1) year from the original date of issuance"). Continuing education: §17-33-202(9) lets the Board require by rule "a maximum of eight (8) hours per International Mechanical Code cycle of continuing education"; the posted 17 CAR §261-120(a)(1) reads "No HVACR license shall be renewed unless the licensee completes at least eight (8) hours of continuing education per current International Mechanical Code cycle that is published by the International Code Council"; the Board's August 1, 2025 memo states that Act 746 of 2025 moves CE "from the current 4 hours required annually to 8 hours per published International Code Council (ICC) International Mechanical Code (IMC) code cycle", imposes a $10.00 monthly late fee on expired licences for up to 36 months with re-examination after 36 months, ends the deferred-licence program, and that "While final rules are being refined and approved, the statutes and this document will be used for enforcement guidance". The rules effective June 3, 2022 (§XXI) still read "No HVAC/R license shall be renewed unless the licensee completes at least four (4) hours of continuing education per calendar year", two of them on the Board-adopted mechanical code, with a 90-day cure period before re-examination.
Home-improvement contract rule
Arkansas Residential Contractors Licensing Law, Ark. Code §17-25-501 et seq. (Residential Contractors Committee): "A person shall not act as a home improvement contractor after January 1, 2012, unless: (1) Licensed by the committee; or (2) Exempt from licensure under this subchapter" (§17-25-505(b)); a "home improvement contractor" is one who contracts for or manages "the reconstruction, alteration, renovation, repair, modification, improvement, removal, demolition, or addition to any preexisting single family residence" (§17-25-502(1)). Exemptions (§17-25-513) include a project "when the cost of the work done or to be done does not exceed two thousand dollars ($2,000)" (not divisible into contracts under $2,000 to evade), a subcontractor of a Committee-licensed contractor, "A person or entity licensed as a contractor by another licensing agency, board, or commission of the State of Arkansas if the contractor is performing work within the scope of the license held by the person or entity" (§17-25-513(5)), and roofing contractors under §17-25-601 et seq. (§17-25-513(6)). No written-contract mandate, cancellation window beyond the federal rule, or deposit cap for home-improvement contracts was located in the subchapter as read.

What to confirm.

Confirm with the Board which rules are enforced today — the rules effective June 3, 2022 (Class C; 15-ton Class B; 4 CE hours per year) versus the statute as amended by Act 746 of 2025 and the posted 17 CAR Part 261 (Class C repealed; 25-ton Class B; 8 CE hours per IMC cycle); the Board's memo of August 1, 2025 says the statutes and the memo guide enforcement while final rules are approved — and the $10 monthly late fee and 36-month re-examination rule, which appear in the memo but not in the statute sections read. A 2025 act concerning claims against home improvement contractors (HB1468, listed as Act 558 of 2025) appeared in a search-result listing and was not read.
